We continue the topic of registering an individual as an individual entrepreneur. In we examined issues related to the individual entrepreneur registration process as a whole: what documents, where and how to submit. In this article, I propose to dwell in detail on one document, without which registration of an individual entrepreneur is not possible - an application. There will be a minimum of text and a maximum of practice: detailed explanations, filling samples and even a video.

An application for state registration of an individual as an individual entrepreneur is filled out in form No. P21001, approved by Order of the Federal Tax Service of Russia dated January 25, 2012 No. MMV-7-6/25@ “On approval of forms and requirements for the execution of documents submitted to the registering authority during state registration legal entities, individual entrepreneurs and peasant (farm) households.” The same document also contains requirements for filling out the application.

General requirements
  • Filling method.
    • On a computer: automatically using special software or filling it out yourself.

    When filling out using a special program, you only need to enter the required data, the application itself will be generated based on them in the required form. If you fill out an application electronically yourself (using Word, Excel, etc.), you must type in your data in capital letters in Courier New font, size 18.

    • Filling out a paper form by hand.

    If the application is filled out by hand on paper, you must use black ink and enter letters, numbers and symbols according to to the following sample(Clause 1.1. Order of the Federal Tax Service No. ММВ-7-6/25@):

  • Corrections.
  • In the completed and printed application there are no corrections, additions and additions are not allowed(Clause 1.10. Order of the Federal Tax Service No. ММВ-7-6/25@).

  • Printing output.
  • Each sheet of the application must be printed on a separate sheet, double-sided printing is prohibited(clause 1.17).     Sheet A “Information on codes according to the All-Russian Classifier of Types of Economic Activities”

    On sheet A, the future entrepreneur must indicate the codes of the types of activities that he plans to engage in after registration. Activity codes are indicated in accordance with the All-Russian Classifier of Economic Activities OK 029-2014 (NACE Rev. 2).

    ! Please note: when filling out economic activity codes, you must indicate at least four digital characters in the corresponding cells.

    An example of selecting OKVED to fill out an application for registration of an individual entrepreneur:

    You are planning to open a specialized store of interior goods (furniture and carpets). In this case, it is unacceptable to indicate code 47.5 “Retail sale of other household products in specialized stores” in the application, since it contains only 3 digital characters. It is necessary to specify by specifying two codes: 47.53 “Retail trade in carpets, carpet products, floor and wall coverings in specialized stores” and 47.59 “Retail trade in furniture, lighting fixtures and other household products in specialized stores.” You can be even more specific by indicating not four characters in the codes, but five: 47.53.1 “Retail trade in carpets and carpet products in specialized stores” and 47.59.1 “Retail trade in furniture in specialized stores.” However, in this case, if you later decide to expand the range and sell, for example, lamps, you will have to add another activity code: 47.59.3 “Retail sale of lighting fixtures in specialized stores.” That's why It is more appropriate to indicate more general, four-digit activity codes.

    The number of declared activities is not limited by law - you can indicate as many as required. If one sheet A is not enough, then one or more sheets A are filled in. In this case, the code of the main type of activity is indicated separately in section 1. All other codes of additional types of activity are indicated in section 2.

    ! Please note: If you fill out several sheets A, then section 1, containing the code of the main activity, is filled out only on the first sheet A.

    • Section 1.

    In the first line you must enter your last name, first name, patronymic (if any) in Russian.

    In the cell intended to indicate the method of obtaining documents confirming an entry in the Unified State Register of Individual Entrepreneurs, or a decision to refuse state registration, the corresponding digital value from the proposed options is entered.

    In addition, section 1 requires you to provide contact information: telephone number and email address.

    ! Please note: If you submit an application via the Internet (for example, through a government services portal or through a taxpayer’s personal account on the Federal Tax Service Inspectorate website), then you must provide an email address. Even if you don’t have one yet (which is rare these days), you’ll have to get one. Otherwise, there is a high probability of refusal to register an individual entrepreneur for this very reason.

    The applicant's personal signature is required at the end of Section 1. If you submit an application to the tax office (or MFC) in person, then you need to sign “on the spot”, in the presence of an official who accepts documents for individual entrepreneur registration. In all other cases (documents are submitted by mail, through a proxy, etc.), the signature must be notarized. Information about the notary is indicated in section 3 “Information about the person who certified the authenticity of the applicant’s signature in a notarial manner.”

    • Section 2 is filled out by the official of the registration authority who accepted the application.

    Form No. P21001 is filled out in accordance with the requirements of Order of the Federal Tax Service of Russia dated January 25, 2012 No. ММВ-7-6 /25@, “On approval of forms and requirements for the execution of documents submitted to the registering authority for state registration of legal entities, individual entrepreneurs and peasant (farm) households.” The order came into force on July 4, 2013.

    Appendix No. 13 of the Order of the Federal Tax Service of Russia dated January 25, 2012 contains form No. P21001. Chapter XIV of Appendix No. 20 of this document regulates the procedure for filling out an application for registration of individual entrepreneurs in form No. P21001.

    In accordance with the order, an application for registration of an individual entrepreneur can be submitted by both a citizen of the Russian Federation, and a foreigner legally present in the territory of Russia, or a stateless person.

    Let's consider the new requirements for registration and completion of the application for state registration of individual entrepreneurs, form 21001, in accordance with Order of the Federal Tax Service of Russia dated January 25, 2012 No. ММВ-7-6 /25@ “On approval of forms and requirements for the execution of documents submitted to the registration authority under the state registration of legal entities, individual entrepreneurs and peasant (farm) farms.”

    New requirements for the design and completion of Form 21001:
  • All letters without exception must be capitalized.
  • Letters and numbers in the application must be written in special cells.
  • The type, color and size of font on Form 21001 are clearly stated.
  • Re-filling of data is minimized as much as possible.
  • The statement added abbreviation rules (for regions, names, countries, etc.).
  • Barcodes have been added.
  • The rules for aligning numbers and letters for document fields are indicated.
  • Strict rules for filling in gaps (lines and breaks) have been defined.
    • the full and abbreviated name of the company in form 21001 is entered exclusively in capital letters in Russian;
    • The TIN (if any) must be indicated in the application;
    • a new field has been introduced indicating the method of obtaining documents on state registration of individual entrepreneurs: personally by the applicant; confidant; by mail.
    General recommendations for the correct execution of an application for state registration of individual entrepreneurs

    In order to correctly fill out an application for registration of an individual entrepreneur, we recommend following the following rules:

    • fill out the application in form No. P21001 for state registration of individual entrepreneurs in capital block letters;
    • be sure to indicate in the application the name (and code) of the registration authority;
    • indicate the OKVED code (minimum 4 characters);
    • number the sheets of the application for registration of individual entrepreneurs;
    • print out all application sheets;
    • make 2 copies of sheet B (“Receipt of receipt...”);
    • sew all sheets of the application (except sheet B and its copy);
    • after filling out the application, sign on sheet A and page 3;
    • cover the threads on the last page with a small white piece of paper and write on it the number of stitched and numbered sheets of the document;
    • have page 3 certified by a notary in case you are unable to personally submit an application to the tax office.
    Recommendations for filling out some fields of form 21001: 1. Filling out the section “Data of an individual entrepreneur”

    The “TIN” field must be filled in only if the entrepreneur has an identification number or when contacting the tax authorities earlier. If you do not have a TIN, there is no need to fill in the field.

    2. Filling out the section “Passport details of a citizen of the Russian Federation”

    Entries are made in accordance with the general civil (internal) passport. In the column “passport series and number” are indicated in the following format: the first two digits of the passport series - a space - the last two digits of the passport series - a space number.

    3. Filling out the section “Code according to OKVED”

    It is necessary to fill in the codes according to OKVED 2 - All-Russian Classifier of Types of Economic Activities Classifier OK 029-2014 (NACE Rev. 2) with amendment No. 14 of September 8, 2017. The first line contains the code of the main type of activity, in all the rest - additional codes. Each of the prescribed codes must have at least 4 digital characters.

    4. Filling out the section “Residence address in the Russian Federation”

    In accordance with Appendix No. 1 to the Requirements for the preparation of documents submitted to the registration authority in accordance with Order of the Federal Tax Service of Russia dated January 25, 2012 No. ММВ-7-6 /25@, the field “Code of the subject of the Russian Federation” must be filled in as follows:

    • for St. Petersburg - 78;
    • for Moscow - 77;
    • for the Moscow region - 50;
    • for the Leningrad region - 47.

    If there is no place of residence in the Russian Federation, then the place of stay is indicated.

    5. Filling out the “Contact Information” section

    In this section you must indicate a telephone number where you can contact the applicant. This can be either a landline or a mobile phone.

    If documents for registration of individual entrepreneurs are sent via the Internet, it is advisable to indicate an email address.

    Abbreviated words in the application for registration of individual entrepreneurs:

    In the "Location" field:

    town - town, d - village, kp - resort village, microdistrict - microdistrict, np - populated area, p - village, s - village, sl - settlement, snk - gardening non-profit partnership, x - farmstead.

    In the "City" field:

    g - city, volost - volost, dp - dacha village, urban-type settlement, rp - working village, s/p - rural settlement.
    In the "District" field:

    rn - district, u - ulus, ter - territory.

    In the "Street" field:

    alley - alley, boulevard - boulevard, shaft - shaft, canal - canal, kv-l - quarter, km - kilometer, ring - ring, embankment, lane - lane, pl - square, pr-kt - avenue, passage - passage, dead end - dead end, street - street, sh - highway.

    In the lines “House”, “Building” and “Apartment” the type of object (in the first field) and its number (in the second field) are indicated in full and without abbreviations.

    Let us briefly explain the basic rules for filling out the form:

  • You can fill in the data manually or on a computer, but when filling it out manually, you need to follow the pattern of characters. When entering on a computer, fill in capital letters, Courier New font, size 18.
  • Dates are entered in the form XX.XX.XXXX, i.e. the day and month are two digits, the year is four.
  • When indicating fractions of a digit before a slash or dot, we write closer to the right edge, after them - to the left. There is no need to indicate kopecks for whole amounts.
  • When filling out activity codes (OKVED), you must enter at least 4 characters (two before the point, two after).
  • The passport series is entered in the format two digits - a space - the next two digits, then another space and the number together.
  • Enter phone numbers without spaces or dashes, always with the area code.
  • We indicate page numbers in special cells in the upper right corner of the sheets.
  • Avoid erasures and corrections.

    Now there are important points that are violated quite often, after which the documents are sent to be corrected.

    • Check all sheets again for errors or unnecessary fields.
    • The information must comply with OKVED 2001 (OK 029-2001).
    • OKVED codes cannot be less than 4 characters.
    • Do not stitch, pierce, etc. sheets yourself.
    • Do not sign anywhere - you must do this in the presence of a notary during certification.
    • Do not stain or wrinkle the sheets - this can also cause refusal.

    After submitting the documents to the tax office, you will be given a receipt confirming receipt of the documents.

    In order to register as an individual entrepreneur, you need to send a package of documents to the tax office, which includes:

    Application on form P21001 – 1 copy.

    Receipt for payment of state duty - 1 copy.

    Copy of identification document (passport) – 1 copy.

    If you plan to work under a simplified taxation system, you can, together with these documents, immediately submit a notification to apply the simplified tax system in two copies.

    Within 3 working days after receiving the documents, the tax office will register you as an individual entrepreneur or refuse if there are reasons or the documents are filled out with errors. After registration, the inspectorate will issue the newly created individual entrepreneur with a notice of registration of an individual with the tax authority and an extract from the Unified State Register of Individual Entrepreneurs. A certificate of registration of individual entrepreneurs on a tax form has not been issued since 2017.

    Methods for sending documents

    There are several options:

    Personal visit to the tax office. You take the documents to the tax office at your place of registration, and pick up the completed documents there. In this case, your costs will be limited to the state duty of 800 rubles.

    Mail. You send the documents to the tax office by registered mail with a list of attachments. The registration package of documents will also be sent to you by mail. Before sending the documents, you will need to have each of them certified by a notary, and this is an additional expense in addition to the state fee.

    Sending through a representative. It is not you who submit the documents, but a representative who acts on your behalf under a power of attorney. In this case, application P21001 and a copy of the passport must be certified by a notary. You can collect documents from the tax office yourself or through a representative.

    Registration of individual entrepreneurs online. This option is a salvation for those who actually live and plan to conduct business far from their place of permanent registration, which means they cannot appear in person at the tax office.

    Registration of individual entrepreneurs online through the Federal Tax Service website

    You submit all documents via the Federal Tax Service website electronically, and receive documents from the tax office in the same way. In this case, there is no need to go to the Federal Tax Service in person. But this option is only available to those who have an electronic signature, because... documents must be certified with digital signature when sent. If there is no electronic signature, you must first apply for its registration to a specialized organization and pay for it according to the organization’s tariffs (approximately 1,000 rubles).

    In order not to issue his own digital signature, a future individual entrepreneur can contact a notary to certify documents with his digital signature for a fee - notaries have this right. In this case, registration documents will also be sent to the notary in electronic form.

    Please note that there are two options on the Federal Tax Service website:

    “Submission of electronic documents for state registration of legal entities and individual entrepreneurs.” If you have an electronic signature and want to open an individual entrepreneur online without a personal visit to the tax office, you need to choose this option. You will need to upload scans of your passport, payment receipts, application P21001, and send them, certified by digital signature.

    “Filing an application for state registration of individual entrepreneurs and legal entities.” This option is not registering an individual entrepreneur online. So you can only fill out and submit form P21001, that is, declare your intention to register as an individual entrepreneur. But this will not free you from the need to personally appear at the tax office with identification documents. Moreover, before sending such an application through the Federal Tax Service, you will need to pay the state fee at the bank or directly on the Federal Tax Service website. Without this, it will not be possible to submit an application through the Federal Tax Service website.
    After submitting your application, you will receive a notification from the registration authority with an invitation to contact the tax authority within 3 days. If you do not appear at the Federal Tax Service within the specified three days, your application will be canceled and you will have to submit a new one.

    Filling out an application on form P21001

    All requirements for filling out are contained in Appendix No. 20 to Order of the Federal Tax Service of Russia No. ММВ-7-6/25@ dated January 25, 2012. You need to adhere to them in order to avoid mistakes and not be denied registration.

    Use the free document preparation service “My Business” to complete the application in accordance with the requirements.

    The form consists of 3 sheets with appendices A and B.

    Russian citizens fill out the first two pages and both applications. The third sheet is intended only for foreign citizens and stateless persons, the rest skip it. It contains information about a document confirming the right of foreign citizens and stateless persons to reside in the territory of the Russian Federation.

    The personal data of the future entrepreneur on pages 1 and 2 must be entered strictly in accordance with the passport data.

    In Appendix A you need to indicate the main code of the type of activity and several additional ones that the individual entrepreneur plans to engage in. When choosing codes, you must be guided by the All-Russian Classifier of Types of Economic Activities OK 029-2014 (NACE Rev. 2).

    If there are many codes and one sheet A is missing, take another one, but do not indicate the code of the main activity again on it. And don’t try to specify as many additional codes as possible “in reserve.” Indicate those that you really plan to do, and you can add new ones at any time.

    Keep in mind that the type of activity you indicate as your main one will determine the rate for insurance against industrial accidents if you hire workers.

    Requirements for filling out an application using the new form No. P21001 for state registration of individual entrepreneurs
    • In section 1 “Last name, first name, patronymic of an individual,” paragraph 1.1 is filled out both in relation to a citizen of the Russian Federation and in relation to a foreign citizen or stateless person. In this case, in relation to a foreign citizen or stateless person, the section is filled out in accordance with the residence permit or temporary residence permit. Clause 1.2 is filled out in addition to clause 1.1 by a foreign citizen or stateless person if the relevant information is available in the identity document in accordance with the legislation of the Russian Federation. For citizens of the Russian Federation, paragraph 1.2 cannot be filled out.
    • Section 2 "TIN" is filled out if you have a TIN. If you have not assigned a TIN number, leave this item blank; the tax office will automatically assign you a TIN.
    • In section 3 “Gender”, in the field consisting of one familiar place, the corresponding digital value 1 or 2 is entered.

    • In clauses 6.3 - 6.6, the type of address object is indicated using an abbreviation as required.
